Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of TraderPal — the website at traderpal.ai, the application at app.traderpal.ai, and related services (together, the "Service") — operated by TraderPal ("we", "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

2. What TraderPal is — and is not

TraderPal is an analysis and journaling tool: it surfaces market data, computes indicators, reviews your imported trades, and generates AI-assisted commentary tailored to your stated preferences.

TraderPal is not an investment adviser, broker, or fiduciary, and nothing in the Service is investment, financial, legal, or tax advice. AI-generated content is informational and educational only. It can be wrong, incomplete, or stale. You alone are responsible for your trading decisions and their outcomes. Trading futures, stocks, and cryptocurrencies involves substantial risk of loss and is not suitable for everyone — never trade with money you cannot afford to lose.

The Service cannot place trades or access your brokerage funds. It has no connection to your broker except data you choose to import.

3. Eligibility & accounts

You must be at least 18 years old. You're responsible for your account credentials and for everything that happens under your account; tell us immediately at [email protected] if you suspect unauthorized access. One person per account. During invite-only periods, access requires a valid invite code.

4. Market data & AI output

Market data shown in the Service comes from third-party sources and may be delayed, incomplete, or inaccurate. It is provided for personal analysis within the Service and may not be redistributed. Always confirm prices on your own trading platform before acting.

AI responses are generated by machine-learning models. We instruct them to be accurate and to say so when data is missing — but you should treat every AI statement as a starting point for your own verification, never as a fact or a recommendation.

5. Acceptable use

You agree not to: share your account or resell access; scrape, harvest, or redistribute the Service's data or AI output as a competing product; probe, overload, or interfere with the Service; reverse-engineer non-public parts of the Service; or use the Service for anything unlawful. Usage limits (such as daily AI message allowances) are part of the Service; circumventing them is a violation of these Terms.

6. Subscriptions & billing

Some features may require a paid subscription. Prices, allowances, and features are shown at purchase and may change with notice; changes apply at your next billing cycle. Unless required by law or stated otherwise, fees are non-refundable. You can cancel anytime; access continues through the period you've paid for.

7. Your content

You own the content you put into the Service — your journal, notes, playbooks, imported trade data, and conversations. You grant us the limited license needed to operate the Service for you: storing your content, processing it through our infrastructure and AI providers to generate your responses, and displaying it back to you. We do not use your content to train models, and we never sell it. See the Privacy Policy for details.

8. Our property

The Service — its software, design, branding, and content we create — belongs to us and our licensors. These Terms don't grant you any rights to it beyond using the Service as intended.

9. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms, create risk for us or other users, or are required to be terminated by law — with notice where practical. Sections 2, 4, and 10–12 survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA OR AI OUTPUT WILL BE ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE (OR $50 IF YOU HAVE PAID NOTHING).

Some jurisdictions don't allow certain limitations; where that's the case, these limits apply to the fullest extent permitted.

12. Governing law & disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

13. Changes

We may update these Terms as the Service evolves. For material changes we'll give notice (in-app or by email) before they take effect. Continuing to use the Service after changes take effect means you accept them.
